ALLEGED BKEAUMES OF CONTRACT. ECHO OF UNWELCOME AUDIT. HAMILTON, Last Night. A Supreme Court action was heard to-day in which Dynes-Fulton, chairman of directors Of the N.Z. Co-oper-ative Dairy Co., claimed £IOOO damages against English and Luxford, former, auditors to the Company, for alleged breach of contract. Defendants counter-claimed for £looo' for an alleged breach of the contract. The action rose out of a former action for alleged defamation by English and Luxford against Fulton, which was settled before coming to Court, a term of the settlement being that there should be no publication of the terms of settlement, other than an agreed upon statement. English and Luxford caused to be published, however, a paragraph setting out the alleged terms, which was followed by a published denial and correction by Fulton. After hearing evidence to-day Mr Justice Ostler reserved, his decision.
