Frederick Theodore Badcock appeared before Mr Justice Ostler today for sentence fqr a breach of the Bankruptcy Act in obtaining over £6OO worth of goods without a reasonable prospect of paying for them. ilis counsel asked for probation, stressing the fact) that Badcock had a good cnaracter at school and in the Army during the war he rose to Adjutant and a. year later to captain. He was in battle at the age of 17. ilie Judge said Badcock had rigU been found guilty. "Had you Obtained tiie goods by false pretences you would have deserved and no douia received, two years’ imprisonment," said the Judge, “hut in my opinionyour moral guilt is just as clear as though you had actually made fradulent representations to 'obtain these goods. You apparently traded on the .act oi your former position and rank in the Army. There is. this to be said in your favour: The jury by its verdict lias found you more of a fool than a rogue.” Probation, added the Judge, was out of the question. The case was very flagrant and he Avas doubtful whether lie had not gone too far in adopting die recommendation of the jury. The sentence of the Court was imprisonment with hard labour for three mouths.
