Burgess,' a supplier and former chairman of directors Qf the.company, the charges being that on December 6UI defendant assaulted informant and used obscene language, in formant, testified that it was a rule ol the factory, known to suppliers, that samples of milk from the composite test bottles would not be supplied to anyone, but if any supplier was dissatisfied with his test a sample would be taken by an officer of the factory and forwarded to the Dairy Division tor testing, 011 December 6UI defendant entered the factory and demanded from witness a sample. This was refused and the regulation was referred to Defendant persisted, however, in his demand and, on being ordered off the premises, showed signs of light. Witness rang the chairman and the secretary, and, on the arrival of the latter, complained qf the behaviour and previous obscene language of the defendant. Defendant then rushed at witness, grabbing him by the throat, and was about to strike him with a clenched fist when the secretary intervened. The Magistrate (Mr. S. L. P. Free) held that there was not sufficient evidence as. to obscene language, and the charge was dismissed. There was evidence as tq the assault. Defendant was cohvietted and fined £l- - costs were 375, and solicitor’s fee £2 2s. Mr H. R. Burridge (Masterton) appeared for informant, and Mr H. McSherry (Pahiatua) lor defendant.
