STRUCK BY MOTOR CAR.

INJURED MAN SECURES £25 DAMAGES. A motor accident which occurred in Fitzherbert Street, Palmerston North, on April 24 last was recalled at the Magistrate’s Court before Mr J. L. Stout, S.M., when George Stout, labourer, of Palmerston North, (Mr Ongley) proceeded against H. Bond, farmer of Rangiotu, (Mr Innes) claiming £IOO general and £9 19/6 special damages. It was alleged by the plaintiff that on April 24 the defendant had negligently, carelessly, and unskilfully driven a motor car in Fitzherbert Street, Palmerston North, whereby he collided with the plaintiff. As a result of the impact, plaintiff suffered a broken leg, and severe head and back injuries, which necessitated his receiving medical attention for over two months. The special damages of £9 19/6 comprised the medical ex-r penses incurred. The circumstances attending the accident were described by the plaintiff, and Dr. Will gave evidence as to the extent of the injuries received. An eye-witness of the affair, Chas. H. Cody, stated that defendant had been travelling at a fair speed, at the time of the crash and had been on the wrong side of the road. Mr Innes intimated that the allegation of negligence was denied. It was suggested that plaintiff had admitted suffering from deafness, and counsel submitted that defendant had driven to the incorrect side of the road in order to avoid plaintiff. This was substantiated by the defendant Bond, who said he was travelling at 8 to 10 miles per hour. He saw plaintiff stop in the- road and thought he had heard the approach of ; the car, but Stout remained in the way of the approaching vehicle.. Had plaintiff continued walking, he would not have been struck.

Judgment was given for plaintiff for £25, with costs.
