The story is that when Fitzpatrick rode up Dan was standing at the door. “You’re my prisoner,” said the policeman. Dan said lie had been riding all day without anything) to eat and Fitzpatrick agreed to let him have some food, before taking him to Benalla. As Dan was going inside Mrs Kelly said, “You won’t take Dan out of this to-night.” Mrs Kelly continued to grumble in an undertone while she placed bread, and meat and tea on the table. Dan appeared to he taking his arrest coolly as if it were a matter of course. The constable accepted the invitation <> oat also, and as he seated himself Mrs Kelly remarked, “If my sou, Ned, was here he would throw you out of the window.” “Here he is now.” exclaimed Dan.

Fitzpatrick turned to look. Simultaneously Dan pounced on him. Mrs | Kelly seized a heavy garden spade used as a fire shovel and struck Fitzpatrick a furious blow on the head. He fell. Several people rushed into the house. Amorig them was Ned Kelly holding a revolver in his hand, which was still smoking. The constable nursed a wounded arm.
