HEAVIYL-LOADED LORRY.

DRIVEN OVER PAEKAKARIKI HILL. Reserved judgment was delivered by Mr F. K. Hunt, S.M., at the Magistrate’s Court, in a ease in which the Hutt County Council proceeded against S. J. Haviil for driving over the Paekakaiiki Hill a vehicle having a weight of more than li tons on each pair of wheels.

His Worship said that he had carefully perused the by-law on the subject, and was satisfied of its vadidity. Defendant must, therefore, be convicted. As far as the penalty was concerned, the council had fixed the fine, without leaving anything to the discretion of the court.

Mr J. O’Donovan, for the defence, submitted that the by-law could not control the decision of the court. It would be repugnant to the system of justice. Defendant was fiued £5 and costs.
