MAGISTERIAL.
TIMARU— -Monday, February 27th. (Before 0. A. Wray, Esq., R.M.) DRUNKENNESS. An usual number of cases of drunkenness were recorded on the charge sheet. There were seven prisoners on these charges, four of them seamen, these and one other arrested on Sunday, and two on Saturday. One “ first offender” was fined 5s or 24 hours ; another 5a and 3s cab hire; a third 5s for drunkenness, and ordered to pay 10« for wilfully breaking a mug value 6d. This man denied being drunk, but admitted breaking the mug, being vexed at being locked up. On the first of the four seamen being brought up Sergt.Major McDonald stated, in explanation of the men being found drunk in the streets on Sunday, that they got some pay on Saturday night, and took a lot of liquor 011 board. Two of them, for drunkenness only, were fined 5s each ; the third, for drunkenness and abusive language in the street when on the way to gaol for the night, was fined 20s as for an aggravated case of drunkenness; the fourth was fined 5s for drunkenness, and 20s for abusive language and resisting the police, and 6a costa of a witness. ASSAULT. _ 1 John McLeod, a seaman on the Araby Maid, was charged with assaulting the master, Bobert Stenhouse, the second mate, William Mackie, and the steward, Jas, Ritchie, on Saturday evening He pleaded not guilty, but admitted resisting being put in irons, Mr White appeared to prosecute. Captain Stenhouse gave evidence that on Saturday evening he was giving the men 10s each to go ashore with, and for sufficient reasons he refused to give accused any money Ho was in tho cabin alone, and accused came in and demanded it. Being alone with him, witness went out and accused also wont out and wont forward. Witness returned to the cabin, and the steward came in for his money and was signing for it when accused came in and said “ Give me that 10s.” (Tho Articles left it to his discretion to make advances in cash during the voyage). Accused than picked up a heavy inkstand containing three bottles, and was going to bring it down on witness’s head, when the steward caught his arm. Called in the second mate, and accused, the mate and the steward had a rough and tumble in tho cabin, accused striking and kicking them, and witness had to call further assistance Accused was very I violent, horribly violent, using bis feet and hands wherever he could. Accused had been an annoyance all through the voyage. He was given 5s the previous Saturday, as all •the rest were. On Monday and Tuesday he did not work ; said he had a boil on his neck, used very abusive language, and said he would not go to work, he wanted to go and see a doctor. Witness would not allow him to see a doctor, ae he could give him what medicine he wanted He went ashore, however, without leave. He worked the other four days of the week. Mr White said Captain Stenhouse had an application to make to have the man dismissed from the ship. , Witness said he considered himself in danger so long as the man remained on board, from what occurred on Saturday night, «nd on previous occasions. . _ Hie Worship pointed out that a special information would be necessary for that, and suggested that the present case be adjourned till fba information was laid. Mr White asked for an adjournment till to-morrow, which was granted, and the prisoner was remanded.
