TEMUKA-YESTERDAY. [Before J. Beswick, Esq., BM.] ASSAULT. M. Dunn and Constable Burke were charged by J. Malarkey with having assaulted him on May I. , Mr Hamersley appeared for the plaintiff. The evidence of the prosecution was not sufficient to maintain the charge and the case was dismissed. ■ CIVIL CASES. Judgment for plaintiff was entered in the following cases:—S. Taylor v. J. Breen, claim £25 Is ; J. Mendelson v. G. Gibbs, claim £SO 14s 6d. The ease F. Franks v. A Grant, claim £l3, (Dr Foster for plaintiff, Mr White for defendant) was. adjourned for a fortnight, BREACH OF “ LICENSING ACT.” . Leonard Tombs licensee of the Arowhenua' Hotel was charged with a breach of this Act. The evidence had beep taken before two Justices about two months ago, but they could not come to, a decision. The Justices, Messrs S. D‘ Barker and J. Mendelson, were now present and the Resident Magistrate said they wished him to act with thorn. Mr Hamersley said the evidence against the defendant had been already heard. The, defendant had now -been summoned again to answer the same charge, and he (Mr Hamersley) submitted that be could not bo twice charged with the same offence. After further argument with the Bench the ease was adjourned for 14 days, . ,
