MAGISTERIAL.

TIMAEU—THIS DAY. (Before E, Elworthy and B. Woollcombe, Esqs., J.P.’s) DRUNKENNESS, J. L. Smith and J. Tierney, two old offenders, were fined 20s each for being drunk and disorderly, witn the alternative of £8 hours. Each of them had 6d on him when arrested. BREACH OF BOROUGH BY-LAWS. J. Houston, ironmonger, was charged with obstructing a footpath in the town by placing 42 sheets of corrugated iron upon it. Defendant admitted the offence, hut

offered as a sufficient excuse that the right-of-way to his yard was obstructed by the Borough Council themselves cutting a trench for water pipes across it, so that he could not get a dray to bis yard. He called two witnesses to prove this. He had carried the iron out of his yard for a customer, who was rather longer in coming for it than he had expected, and it only took up a very small portion of the footpath. He told the policeman the circumstances, but the constable was not satisfied with his explanation. The case was dismissed, the excuse being held by the Bench to be quite sufficient. D. D. Stewart, express driver, who did not appear, was fined 10s for leaving his horses unattended in the main street on the 4th inst. The Court then adjourned.
