MAGISTERIAL.

TIMARU—THIS DAY. (Before B. Beetham, Esq., 8,M.) DRUNKENNESS, Charles Gosling, Thos, Wood, and J. L. Smith, were charged with being drunk and disorderly the previous day. All three were old offenders, and numerous convictions were on record against thorn. Smith had kept steady for some eight months, however, and he was comparatively lightly dealt with, being fined 10« for 48 hours. Gosling and Wood were fined £5 each, with the alternative of 14 days’ imprisonment with hard labor. They pleaded to ha leniently dealt with, and promised to go straightaway and “ take the pledge.” His Worship said he was so used to hearing this promise made that he paid no attention to it. larceny as a bailee. John King, Auctioneer, was charged with the larceny, as a bailee, of 35 bags of oats, the property of Messrs Peacock and Goaney, out of a quantity of 250 bags placed in his hands by them for sale. Mr Hamersley appeared for the prosecutors. The accused said he had not retained counsel. He had been in communication with Mr Hamersley, but at the last moment he had received answer that he was retained for the other side. Mr Reid, after a few moments conference with, accused, said he would apply on accused’s behalf for a remand, so that he could make arrangements to obtain counsel. Another case would be coming on against King on Friday and he would suggest that a remand be granted till that day. Mr Perry said he was engaged on the case to be brought on Friday, and he would not be ready to proceed.

It was therefore decided to remand the present case till Monday. Bail was airanged, accused giving a bond for £IOO and one surety in a bond for £IOO.
