MAGISTERIAL.
TIMARU—THIS HAY. (Before R. Beetham Esq., R.M.,) DRUNK AND DISORDERLY. A first offender was fined os. ALLEGED RAPE. Thomas Ness was charged on remand with committing a rape on the person of Mary Hnlston. The prosecutrix gave evidence to the effect that on last Monday morning between 8 and 9 o’clock the accused to whom she had never spoken before, asked her to come for a walk with him, and shortly afterwards committed the offence with which he was charged. The Court was crowded when the case began, but soon after the prosecutrix commenced to give her evidence His Worship ordered it to be cleared. Most of the evidence taken was unfit for publication. Dr Macintyre was the last witness and deposed to having examined the prosecutrix, fie had failed to discover anything to lead him to suppose the alleged offence had been committed. Relying chiefly on the medical evidence, His Worship discharged the accused, who left the Court. The Court then rose.
