(Before R. Beetham Esq., R.M.) THE CAPTAIN AND THE TAR. John Basilica, a foreigner, was charged by Captain Moir, of the barque Portland, with refusing duty yesterday. The defendant, who pleaded not guilty, on being interrogated by the Bench complained that the vessel was shoit handed, and that the provisions served out were not fit to eat, together with other complaints. Captain Moir denied the truth of the defendant’s statements, and said that ho had never had any complaints before. Some pickled meat lately opened had not been so good as it might have been, hut that had been through the negligence of the the officers, and was not his (Captain Moir’s) fault. He had personally nothing to do with these things. In reply to His Worship the defendant said he was acting on his own account in making these complaints. His Worship said that he mast make an example of tbo defendant. He would be sent to goal for 1-4 days, and would then go aboard his ship, civil. CASES. John Scott, £27 18s 2d ; James Bruce v J ames Wiggins, £lO 15s 7d; J. Clayton v George Cook, £4 18s Bd. T. T. Brownell v Silburn—Claim £26 9s 3d. Mr Reid for plaintiff; Mr Jameson for defendant. Judgment reserved. Same v Hornsey—Claim £lll3s for timber supplied. £lO 9s admitted. Mr Reid for plaintiff. Judgment for amount claimed with costs. JUDGMENT SUMMONSES. Young v. Wildermoth. Adjourned at plaintiff’s request until July 26 in order to give the defendant time to settle. P. B. Raymond v John Cook. Adjourned for production of further evidence. Edmund Hope v Alex. Ferguson. Adjourned for one month by the Court.
