MAGISTERIAL.

TIMAEU—THIS DAY. (Before F, Archer and F, LeCren, Esqs, J.P.’s) THE CHARE OE EMBEZZLEMENT AGAINST A RAILWAY EMPLOYEE. Joseph Jas. Farrell, was charged on remand with embezzling two guineas, the property of the Government. Mr Jameson appeared to prosecute, Mr Haraersley was present on behalf of the accused. Mr Jameson said that he found it would be necessary to ask that the accused might be further remanded until Wednesday next as it was proposed to bring another charge against him, and the prosecution was not quite prepared to proceed for a day or two. Mr Ilamersley said ho must object to a further remand being granted unless the other side stated the nature of the other charge referred to by Mr Jameson. It would be very hard that a man should be had up and told that there was another charge hanging over his head, the nature of which he was to be kept in ignorance of while another remand wna asked for. If the Bench thought proper he (Mr Ilamersley) could quote from “Johnston’s Justice of the Peace” to show that they were bound to hear evidence before they granted a remand. Wednesday lie might further state would bo a. very inconvenient day for him to attend the Court. If a _ remand was granted he would ask that it might be until Tuesday. The. accused was accordingly remanded until Tuesday next, the same bail as before being accepted for Ins appearance, on Mr Ilamersley’s application. AN ACTIVE COLONIST. James Slack was charged with horse stealing at Waimate. Inspector Pender stated that the accused had only just been liberated from Dunedin gaol, where he had been serving a term for burglary. Immediately on his release he was re-arrested on

suspicion of being concerned in two cases of horse stealing, and as the offences were committed at Waimate he (Mr Pender) would like a remand to that place. The accused was remanded to Waima'e for this day week. The Court then rose.
