MAGISTERIAL.
TIMAKO—THIS DAY,
(Before E. Beetham, Esq., E.M. and E. Elworthy, Esq., J.P.) BKEACHES OF BOROUGH BYE LAWS. John Davidson was charged with obstructing a public thoroughfare by refusing to move his dray, when requested to do so by Mr Samuel Bristol. The defendant was also further charged with leaving his dray unattended. Mr Perry appeared on the behalf of the Borough Council.
The defendant pleaded not guilty, to both charges. It appeared from the evidence of Mr Bristol, that on Feb. 18, he was driving in a buggy on the belt, when he overtook the defendant, who was in charge of a dray. The Jray was drawn right across the road, and complainant’s buggy was unable to pass. On being requested to move the dray, the defendant refused. The defendant pleaded that he had a load of 1500 ft of timber on his dray, and that he moved as quickly as he could. The Bench considered both charges proved. Fined 10s and costs in each case. FAILING TO MAINTAIN. John Tozer was charged with neglecting to pay for the maintenance of his two children committed some time since to the Burnham Industrial School. The amount of the defendonts indebtedness was stated as £9, and of this sum he said he was in a position to pay only £3 at present. At this stage Mr Beetham remarked that the defendant appeared to be in an intoxicated state, and the case would therefore be adjourned until to-morrow.
