TIMARU-THIS DAT.

(Before His Honor Judge Ward). THE TIMAHU RIOT CASE. The delivery of judgment in this case was adjourned until to-morrow morning. CIVIL CASES. McDonald v Hoare—Claim £177 7s fid. Mr Hamersley for plaintiff; Mr Jameson for defendant. The short facts of Disease were as follows :—The plaintiff, Jas. McDonald, leased the Educational Reserve, No. 1200, situated at Raincliff, from the Educational Commissioners in 1879, and entered into possession of the same on Nov. 1 of that year. The property formed part of the run of the defendant, and there was about 2\ miles of fencing on it at the time that the plaintiff negotiated for the lease. On taking possession, however, of the property, he discovered that only about forty chains of the fencing was standing, the remainder having been taken down, but it was not removed until afterwards. The plaintiff stated that he had received £SO from the Commissioners as part compensation for the loss of the fencing. The plaintiff pleaded that as he had erected the fencing on the reserve prior to its occupation by the plaintiff he had a right remove it at pleasure. The trespass was admitted, and £lO had been paid into Court on that account.

After some argument, judgment was given for the plaintiff fof-£lO 10s and costs, by the consent of the defendant. White v Green—Claim, £ll7 17s 9d for services rendered.

Adjourned, at the request of Mr White, for one month. IJt BANKRUPTCY. Orders .of discharge wee granted to the following debtors on the application of Mr Tosswill: —Henry Thornton ; William Ormond, Caleb Crompton, and Jas. William Crompton. Be John Hall, a debtor, and a certain order of Nov. 16th last, relative to the property of the debtor (two horses.) Mr Tosswill appeared for the debtor, Mr Hamersloy appeared to make application that the order be made absolute. His Honor directed the order to bo made absolute with regard to one of the horses. probate. On the application of Mr Hamersley, letters of administration were granted to Julia Johnson, widow of Edward Johnson.

The Court then adjourned till to. morrow.
