Judgment for plaintiff for the amount claimed by default. Temuka : Hoad Board: v. D. Hoarc— Claim, £2 11s 3d,’amount of rates due. George Bolton; I am Hate-collector tojthe Tcmuka Hoad Board. Mr Hoare’s name appears on the rate roll for 1880. I posted on the slh August last a demand for the rate addressed to Mr Honre, Shamrock Hotel, Timaru. Mr Hoaro did not object at the Assessment Court, nor has he applied to the Board for another person’s name to bo substituted for hi son the valuation i*oll, and he has not objected in any manner until now to pay the rate. Ido not know to whom the land belongs. The Board cannot make any other person responsible for payment of the rate, while Mr Iloare’s name remains on the roll. The amount of the rate is still unpaid. Mr Hoare, in reply to his worship, said that he had not owned or occupied the land for the past two years, and that the land belonged to Mr Perry, Timaru, but be had taken no steps to have his name taken of the roll.

His Worship said that the defendant ought to have looked after his own interests and have had his name taken off the roll, but the Board could distrain on the land, and on that ground was proceeding to give judgment for the defendant, when Mr Bolton applied for a nonsuit which was granted.
