Wood and Horn brook. Judgment summons. The debt was ordered to be paid at once, in default 30 days imprisonment. Franks v. Derrock. This was an ad journed action brought to recover £37 10s for damages alleged to have been dune to a draught horse and a quantity of malt. The plaintiff was re-examined and described his malthonse, and the dillieulty winch a horse, under ordinary circumstances, would have in gaining access to it. A witness named Whitehead stated that unless the slip-panel was taken down or some barrels removed in front it would be impossible for a horse to enter the brewery.
Air White addressed the bench for the defence contending that the damage was caused by plain! ill’s son taking down the slip-panels ami thus enabling the horse to reach the malthonse. He called Defendant, who stated that under instructions from Air Lees ho was taking the horse to the. pound. The horse was a quiet one, but it turned several limes, and lids was flic reason be rode so fast, it went through the slip panel which young Franks took down. AVitness tried to drive it out of: Franks’ paddocks again. He did not drive il into the brewery, nor did be intend to so. He was not allowed to follow the horse past the paddock. Had driven the same horse out of the brewery within the last three years on iivc or six occasions. By Air Hamorslcy—l never took a glass of beer by myself. Sometimes I have had a glass of beer when I have been asked. Never went to turn the house out with the intention of getting a glass of beer. I do not know much about driving horses. I was just 20 minutes in possession of the horse. The horse went about six chains past the road to the pound. The case was further adjourned till next sitting. The court then adjourned.
