TIMAHU—THIS DAY. (Before R. Bcetham Esq. R.jVT.) DEUXKKXNKSS. Au inebriate was fined ss. CIVIL CASK. Taylor v Rogers—Claim £8 17s ; judgment summons. This case had been allowed to stand over from time to time for a considerable period in order enable the defendant to obtain the money. In reply to his Worship, defendant now stated that he had no money, and no property on which he could realise. His business expenses swallowed up all his gains. The plaintiff being anxious to arrive at a settlement, his Worship asked the defendant if he could pay 10s per week in liquidation of his debt. The defendant replied that it was impossible ; he would not have the money to do it.

His Worship, addressing the plaintiff, said that it would clearly be useless for him to make an order for the payment of this money, if the defendant was really unable to pay it. The plaintiff remarked (hat it was a. very hard case for him. The defendant had obtained goods from him, which he had almost immediately afterwards realised on, while he (plaintiff) was still waiting for his money. His Worship said that he thought the best thing to be done under the circumstances would be to allow the matter to stand over for another three months, as by that time, perhaps, the defendant ■would be in a position to settle the claim. The Court then adjourned.
