James Miller, farm manager at Waitohi, said he was at defendant’s store on Fell. 7, in the evening. Had a glass of beer but did not pay for it. Told Kirk (a man on the road) to get a drink of beer, and gave him Is to get it. he ub-

tained the beer ; the Is was returned to witness but not the same night. William Reek, farmer, AVaitohi, deposed : AVas with last witness on Feb. 7, last. Had a glass of beer and gave a man named R.oddock a shilling. Believed it was Mrs Liston that gave Eoddock the beer. Murphy, the storeman, was not in the store at the time, but was there afterwards. Had some sardines and beer. They were booked to me, and 2s was charged tor the beef. Mr Hod by contended that the case must be dismissed, as there was no proof that defendant had not a publican’s license. Case dismissed.

Sergeant Carlyon applied for a fresh information.
