OHAKUNE DISTRICT COURT
The following undefended cases were heard by circuit Judge Batty Lovegrove in the Ohakune District Court on Thursday 1 February. Senior sergeant Ross Beilby of Ohakune appeared for the prosecution. Assault on publican Colin Barry Phillips, 40, bushman of Raetihi, was remanded without plea to appear on 29 February to answer to a charge of assaulting Trevor John Dickson, proprietor of the Ruapehu Hotel in Raetihi, by using a bar stool as a weapon. Counsel: Paul Brown. Drink driving charges • Orson Mokena Hiroti, 22, unemployed of Raetihi, was remanded without plea to 29 February to answer to a charge of driving with an excess breath alcohol reading of 704: 1 in Ward Street, Raetihi, on 13 January. The remand was to enable the defendant to seek legal aid. Counsel: Eric Forster. • Richard Kane Horne, 29, shearer of Raetihi, pleaded guilty to a charge of driving with an excess breath alcohol reading of 861:1 at 2am in Pitt Street, Raetihi, on 21 January. He was convicted and remanded to 29 February for a probation officers report and sentence. Counsel: Paul Brown. • May Ponga, 45, garden worker of Raetihi, pleaded guilty to a charge of driving with an excess breath alcohol reading of 773:1 on the Ohakune/Raetihi road at 8.45pm on 25 January. In convicting and sentencing her to 70 hours community service and imposing a 7-month disqualification period, Judge Lovegrove said he had taken into account that this was her first offence in 25 years of driving. • Richard Samuel Toko, 24, log line operator of Waiouru, was remanded without plea to appear on 29 February to answer to one charge of driving with an excess breath alcohol level of 1 1 25 : 1 , and to one charge of driving while disqualified on the Parapara Road (SH4) on 1 7 December. Bail was allowed with the condition that the defendant does not drive any type of motor vehicle during the remand period. Counsel: Eric Forster. • Paul Neil Whale, 21, labourer of Ohakune, pleaded guilty to a Charge of driving with an excess blood alcohol level of 1 44: 1 (the limit is 80: 1 ) on the Rangataua Road on 28 October. Court heard how all four occupants of the car he collided with after drifting across the centre line had been injured. He was convicted and remanded to appear on 29 February for a probation officers report and sentence. Counsel: Eric Forster. • David Zane Cadwallader, 32, shearer of Raetihi, was remanded to appear for a defended hearing on 28 March after pleading not guilty to one charge of driving with an excess breath alcohol (987: 1) and to one charge of driving while disqualified on SH4 (Valley Road) on 22 September last year. • Gregory Ernest Norman Weston, 32, saw doctor of Ohakune, pleaded guilty to one charge of driving with an excess blood alcohol level of 192: 1 (the limit is 80: 1) and to one charge of careless use of a motor vehicle on SH1 at Vinegar Hill near Hunterville on 15 November.Court heard how the defendant had lost control on a wet road and ended up in a ditch. On the drink-driving charge he was convicted and fined $950, court costs $95 , and disqualified for 10 months. On the careless-use charge he was convicted and discharged.
