General melee avoided
JohnCharles Russell, 37, unemployed of Ohakune, pleaded guilty to charges of assaulting a male and causing damage to a car dooron 17 September. Court heard from the defendant how he had been provoked by name-calling and the yelling of abuse from the occupants of a car parked opposite the Hot Lava Niteclub in Rimu Street. He had Confronted the occupants of the vehicle but when they wound the car window up he had slapped it with the flat of his hand.
The glass smashed and splinters struck one of the occupants. Russell told the Court that he hadn't intended breaking the car window and, having done so, offered to pay for the damage immediately. He acknowledged that he shouldn't have let the provocation and abuse get to him. In convicting and fining the defendant $100, court costs $95, and ordering reparation of $65 forrepairs to the car door, Judge Watson said that one good feature of the incident was that it hadn't escalated into a big melee between the occupants of the car and the defendant and his friends.
