OHAKUNE DISTRICT COURT

The following cases were heard by Judge Gregory Ross at this month's Ohakune District Court sitting on Thursday 13 April. Police sergeant Bob Evans of Ohakune appeared for the prosecution. Careless use causing death Matthew Haines, 20, unemployed of Auckland, was convicted and fined $500, court costs $95, on a charge of careless use of a motor vehicle causing the death of his passenger Phillip Francis Lumsden of Ohakune on the Raetihi/Ohakune road on 15 July last year. He was also disqualified for 1 2 months after being found guilty following a defended hearing. A charge of driving with excess blood alcohol was dismissed after Judge Ross ruled that the certificate used was defective. Common assault Selwyn Raymond Herewini, 45, unemployed of Raetihi, was convicted and fined $200 and ordered to pay court costs of $95 after pleading guilty to assaulting a female on 13 January at Makakahi Valley. Half of the fine is to be paid to the complainant. Suspended sentence Raymond Charles Spry, 42, leading mill hand of Ohakune, was given a 6-month prison sentence suspended for 18 months when he appeared for sentence on a charge of assaulting a female on 22 February at Ohakune after pleading guilty to the offence and being convicted last month. He was also fined $400 with court costs $95. Two pleas of guilty Michael Richard Anthony Pirere, 21, unemployed of Ohakune pleaded guilty to one charge of unlawfully taking a motor vehicle and to one charge of careless use of a motor vehicle causing injury. Both offences occurred on 28 January. He was to appear for sentence on 18 May. Burglary charge Joseph HohepaMallinson, 25, unemployed of Ohakune, was remanded without plea to appear on 1 8 May to answer a charge of breaking and entering a building with intent to commit a crime between 4 and 10 January. Outstanding fines of $3385 were also recorded. Theft charge

Clayton John Henare, 19, unemployed of Raetihi, was remanded without plea to appear on 18 May to answer a charge of theft of a television set between 21 and 29

March. Outstanding fines of $1490 were also recorded. Remanded without plea Tammy Kade Davis, 19, unemployed of Raetihi, was remanded to appear in the Ohakune District Court on 18 May to answer two charges; one of theft and one of possession of cannabis on 9 March. Offfensive behaviour Leslie James Christensen, 19, unemployed of Raetihi was convicted and fined $200, court costs $95 after changing a plea of not guilty to guilty on a charge of behaving in an offensive manner. Court heard that he had peered through a hole in the wall of the womens toilets at the Raetihi showgrounds on 18 February. Sentenced to supervision Darrin Paul Sakey, 21, unemployed of Ohakune, was convicted and sentenced to nine months supervision on two charges of receiving after pleading guilty at last month' s hearing. He was ordered to undertake counselling as directed duringthe supervision period. Theft Patrick MaiaLeander Barton, 1 9, unemployed of Raetihi, appeared for sentence on three charges of burglary of the Ruapehu Hotel in Raetihi after pleading guilty to these charges at last month's hearing. He was convicted and ordered to come up for sentence if called upon within the next 1 2 months. He was also ordered to make reparation of the $2159 he had taken during these burglaries. Mixed pleas Adrian Michael Brown, 18, unemployed of Raetihi, was remanded to appear again on 18 May on two charges to which he had entered different pleas. On a charge of driving while disqualified on 20 December he pleaded guilty but to a charge of unlawfully taking a motor vehicle on or about 20 December he pleaded not guilty. On a further charge of breaching bail he was remanded without plea to answer the charge next month.
