Acquitted of illegal entry

Darren Mathew Dempsey, 20, unemployed of Auckland, was charged that on 20 July 1989 he was in a dwelling unit, owned by an Auckland woman, unlawfully. He had pleaded not guilty and the case was dismissed.

Dempsey told the court he knew the owner's daughter and had her permission to use the laundry in the unit and that she had shown him where the key was kept. Judge Toomey said Dempsey had raised the statutory defence that he had reasonable grounds for believing he was entitled to enter the unit. The court was satisfied there was no intention to commit any other offence and, because the discussion with the owner's daughter was so confused a conviction would not be entered.
