OHAKUNE DISTRICT COURT

The following cases were heard in the Ohakune District Court last Thursday by Judge Ryan from Palmerston North. Police Sergeant Russell England of

Ohakune appeared for the prosecution. Traffic Officer Ken Climo of Taumarunui appeared for the Ministry of Transport.

Shoplifting Steven Aaron Albert was further remanded at large to appear in the Ohakune District Court on 23 November to face a charge of stealing a bag of Minties valued at $1.75 from the Ohakune New World Supermarket on 9 August. Assault Clinton James Bishop, 24, - farm labourer of Ohakune, was convicted and sentenced to one year's supervision and ordered to undertake marital and drug and alcohol counselling for committing an assault on a female on 17 September. Disqualified driving Steven Xavier Bishop, 21, garden labourer of Ohakune, pleaded not guilty to a charge of driving while disqualified on SH49 on 3 October. He was remanded on bail to 21 December for a defended hearing. Counsel Paul Brown. No licence Lindon -Desmond Blake, 23 bushman, Rotorua, pleaded guilty to a Ministry of Transport charge of driving a motor vehicle on 5 May without having had a driving licence at anytime. He was convicted and fined $100, court costs $65, and advised to get a driving licence as soon as possible. Deferred Murray Edward Boyd, 42, Butcher of Taumarunui, was to have

appeared on a charge of driving with excess blood alcohol in Clyde Street, Ohakune, on 26 June. However, as there was no confirmation of proof of service, the case was deferred until 23 November. Driving charge Kerry John Breen, 18, soldier of Waiouru, pleaded guilty to an amended charge of: "While driving under the influence of alcohol but not so as to be guilty of an offence thereby did cause injury to a passenger by careless use of a motor ve- ' hicle on 26 June." Court heard how defendant, accompanied by a group of fellow servicemen from Waiouru, had been travelling to Ohakune when defendant was distracted by his passenger and lost control of his motor vehicle (valued at $5000) which ended up a 'write-off. It was one of his passengers - Hayden David Delves - who suffered the most serious injuries to his spine. Defendant was convicted and fined $800, ordered to pay court costs of $65 and disqualified from driving for 12 months. Counsel: Duncan Harvey. Cannabis John Craig Brown, 27, unemployed shearer of Ohakune, pleaded guilty to a charge of possessing a class'C' drug (cannabis plant) on 25 September. he was convicted and fined $150, court costs $65.

Seven charges Stephen Hoani Brown, 18, unemployed shearer of Rangataua, appeared on one charge of breaking and entering, one charge of cultivating cannabis, one charge of unlawfully taking a tractor valued at $7000, one charge of unlawfully taking a Valiant Ranger valued at $2000, two charges of unlawfully taking bicycles valued at $269 and $100, and one charge of causing intentional damage to a Valiant motor vehicle. Following pleas of guilty he was remanded to appear in the Ohakune District Court on 23 November for sentence. In the meantime he was ordered to undertake alcohol and drug assessment, to live at home (Ohutu Grazing), to observe a curfew at that address between the hours of 8pm to 6am and not to consume any alcohol or drugs until his next appearance. Converting charge David Zane Cadwallader, 26, shearer of Raetihi, pleaded guilty to a charge of driving with Excess Breath Alochol on SH1 on 29 September but not guilty to a charge of converting a 1987 Holden Commodore valued at $28,000 between 25 and 29 September. He was remanded on bail to appear in the Ohakune District Court

in 21 December for sentencing on the guilty plea and for a defended hearing on the not guilty plea. Counsel: Paul Brown. Intentional damage William Callingham, 22, labourer of Ohakune, pleaded guilty to three separate charges of causing intentional damage to car windows totalling $1470 in reparation claims. Court heard how defendant was involved in a confrontation with fellow party members on the night of 14 September and, after being asked to leave, returned and used a piece of timber to break the windows of three cars belonging to out of town party-goers. He was convicted and remanded to appear in the Ohakune District Court on 23 November for a reparation report and sentence. Counsel: Paul Brown. Remanded Darren Mathew Dempsey, 19, unemployed of Auckland, now living in Ohakune, was further remanded to appear in the Ohakune District Court on 21 December on a charge of being found unlawfully in a dwelling house in Shannon Street, Ohakune on 20 July. Counsel: Paul Brown. Drugs charges Keith Nelson Ellery, 26, labourer of Ohakune, pleaded guilty to one charge of possessing a pipe for the purpose of committing an offence under the

Misuse Drugs Act and to one charge of cultivating cannabis plants (90 seedlings) on 25 September. He was convicted and remanded on bail to appear in the Ohakune District Court for a probation officer's report and sentence. Counsel: Paul Brown. Cannabis Julian Alexander Patrick Taylor, 22, unemployed landscape gardener of Ohakune, pleaded guilty to a possession of cannabis leaf on 25 September. He was convicted and fined $75 and ordered to pay $65 court costs. Careless driving Ian Alexander Hays, 34, catering supervisor of Ohakune, pleaded not guilty to a charge of causing bodily injury to Michelle Winn by careless use of a motor vehicle on 18 August. He was remanded at large to appear for a defended hearing in the Ohakune District Court on 21 December. Counsel: Paul Brown. Drugs charge Jason Myles Hern, 20, unemployed of Ohakune, pleaded guilty to a charge of possessing one 'bong' and three knives for the purpose of committing an offence under the Misuse of Drugs Act on 25 September. Driving charges Aaron Tremain Prior Horne, 21, unemployed of Raetihi, pleaded guilty to one charge of driving with Excess Breath Alcohol and to one charge of driving while disqualified along the Ohakune road towards Raetihi and

then into Valley Road on 23 September. He was convicted and remanded on bail to appear in the Ohakune District Court on 23 November for a probation officer's report and sentence. Counsel: Paul Brown. Arrest warrant Stuart Campbell Humphrey, 21, unemployed of Hamilton, was to have appeared on a charge of driving dangerously in Miro Street, Ohakune, on 13 August. When he did not appear a warrant for arrest was issued. Cannabis Marc Callum Keesing, 19, chef of Ohakune, pleaded guilty to a charge of possessing cannabis leaf on 25 September. He was convicted and fined $150 and ordered to pay $65 court costs. No sample Michael Jude Kennedy, 58, farmer of Ohakune, pleaded guilty

to a charge of refusing to supply a specimen of blood when requested to do so by an enforcement officer after he had been stopped in Miro Street, Ohakune, on 1 October. Defendant explained to the Court that he realised he was under the influence of alcohol and admitted to being so at the time to the officer in question and therefore did not think a specimen of blood was necessary. He was convicted and fined $600, ordered to pay $65 court costs and disqualified from driving for 6 months. Careless use Owen James McLean, 26, umemployed of Ohakune pleaded not guilty to a charge of careless use of a motoi vehicle in Mangawhero Terrace, Ohakune, on 14 September. He was remanded at large to appear in the Ohakune District Court on 21 December for a defended hearing. Driving charges Cyril Sidney Mott, 62, contractor bushman of Ohakune, appeared on one charge of driving with Excess Blood Alcohol and one charge of careless use of a motor vehicle in Shannon Street, Ohakune, on 6 July. At the request of his legal counsel, defendant

was allowed to make no plea at this stage but was remanded at large to appear in the Ohakune District Court on 23 November for the taking of pleas to answer both charges. Counsel: Paul Brown. Social Security Rex Colin Newman, 34, unemployed of Ohakune, pleaded not guilty to a charge of breaching the Social Security Act. Court heard how defendant had allegedly admitted to living in a de-facto relationship in order to mislead an officer responsible for the administration of the Social Security Act in order to obtain the Domestic Purposes Benefit. He was remanded on statutory bail to appear in the Ohakune District Court on 21 December for a defended hearing. Counsel: Duncan Harvey. Remanded John Robert Craig Paine, 47, banker of Auckland, requested through counsel, that the charge of refusing to accompany a police constable to the Ohakune police station on 17 September be remanded to the Ohakune District Court on 2 November.
