M OTHER TAKES DAUGHTER ON VOYAGE TO LONDON FATHER GOES TO LAW Sydney, October 19. Litigiation co-ncerning the custody of the baby daught.er of Mfrs. Janet Mary Tol-e, of Auckland, New Zealand, had an ahrup-t en-ding in the Su-pre-me Court before His Honour Mr. Jusitice Long-Inne-s. The -child was brought here aboard the Wanganella on Tuesday by her mother, who is taking her to England in Saturday's liner. The fath-er, who- is now co-miing from) New Z'eaiand, desired to prevent •the mother having custody and in-structe-d> a Sydney solicitor to ■ apply for a writ of habeas corpti-s. During the proceedings an effoii was made tto comtpel the mother to •enter the witneis-s hox, but the judge declined and Mrs. Toi© left the court. D-uring an argumient with her solicitor, the judge sddd he saw nio reas-op wh'y she should not leave-, and no reason why sh© should he used to prove the case for the other s-ide. The judge alsp hinted Itbat legi-s-latio-n wias now before Parliament to alter -ca-ses such as this, whereby a husband is the sole custodian at law. Th'e writ of habeas eorpus was refused. Auckland, Thursday. Mirs. Janet Mary Tole i-s the wife of Mr. George Tole, of Auckland. She left with the chiid on the 'Wanganella, it being understood that she- was go-in-g to visit her mother, M!rs. PerCy Crisp, formerly Mrs. Clarkson, of Christchurch, now; in Londb-ni.
