found guilty of causing accident through Negligence

Wellington, Friday. Noel William McColl (23) stationer, of Otorohanga, stood trial on a charge of negligently driving a car so as to cause the death of a youth, David Ellis, at Takapuna, on May 7. Ellis was found dying on the i'oad on a dark rainy night, and the Crown alleged that he was struek hy McColl's car. The Crown called as witness accused's sister-in-law, Anne H. Roberts, who said that accused and his wife and child were in the front seat of the car and witness in the back seat. When passing through Takapuna her sister sudclenly _ became very excited, and seemed frightened. Witness thought her sister said excitedly, "Go on." "We seemed to be all talking at once," eontinued witness. "My sister seemed frightened as though we might have struck something. I don't remember what accused said. After a while I think my sister said, 'Noel, I think we hit something.' I felt the slightest sort of a brushing, hut no impact." In answer to many of the Crown Prosecutor's questions, witness said she could not remember, and the judge finally remarked, "Is it worth while, Mr. Meredith?" Accused was found guilty with a strong recommendation to merey. He was remanded for sentence^
