An anomaly in the- provisions of the Mortgagors' and Tenants' Relief Act has been pointed out to Mr. D. Le C. Morgan, secretary of the North Taranaki branch of the Farmers' Union, who has made representations to the Prime Minister to have the necessary alterations made to the Act. It is ciaimed that aeeording to the Act under leases the lessor can put a bailiff in and, though the lessee may make an immediate application for relief and obtain it, there is no power under the Act to remove the bailiff. Therefore the bailiff can claim continuous statutory fees and' so defeat the privileges of the Act. Other features of the Act which it is considered require investigation have been pointbd out to the Prime Minister. The Act expires on Desember 31, 193-3, and unless the assistance of the Act is taken befcre that date the farmer will be back in his original position before the Mortgagors' and Tenants' Relief Act was brought into force. Any assistance obtained under the original Act was by the amendment extended for 12 months, meaning that such assistance provided by the Act in a great many cases will expire in 1934, whereas assistance obtained later will expire in April, 1935. "You are well aware," states the letter written by the pa-ovincial secretary to the Prime Minister, "of the position at the monlent and the prospeets of such improvement to allow for the removal of the provisions of the Act, so therefore it is not necessary to deal with the- present position of the farmer and the necessity of protection, but unless something is being done by the Government I must advise all my members in my distriet to make application for relief before December 31, 1933," even though there may be an amicahle arrangement between the farmer and the mortgagee."
