"WIZARD" SMITH CASE ALLEGED FAKED REPORTS SUPPLIED TO N.Z. PRESS ' CONDITION OF BEACH

Rec. Oct. 27, 12.5 a.m. Sydney, October 26. Ludwig Nudi, who accompanied "Wizard" Smith to Ninety-Mile Beach as an ignition expert, was cross-ex-amined about the reason for the violent estrangement between himself and Smith, and replied: "I had criticised a reporter for sending a wrong report concerning the state of the beach to th'e New Zealand Herald. I told him it was deliberate lie to say that the beach was bumpy and full of shells and washouts, when it was in perfect condition. The reporter answered that it had nothing to do with him as Smith had signed the telegram." Mr. Holman, K.|C., counsel for- the defence, claimed that th'e real reason of the estrangemehU was that Smith gave certain instructions, after seeing the articles, and these witness had furnished to the New Zealand press. Donald HaPkneSs, designer of Smith's car, gave evidence that the car had a gear ratio sufficiently high to brealc the record of 243/ miles an hour. Th'e case was adjourned.
