How a former convict transported to Tasmania for embezzlement of his master's money attempted to make redress in his old age by leaving half his, property to his former empioyer's wife was told in th'e Adeiaide Civil Court to-day; when Mr. Justice Ahgas -Parsons was asked to decide who was entitled to the estate of Johli Herring Kenhedy, who died at Golden Grove (S.A.) on May, 31, 1870. . The. estate, which was wprth £1000 when Xennedy died, was valued at £10,000 about five years ago, when his daughter died without issue. In the event of his daughter dying without issUe, testator left half his estate to a Mary Hathaway, and the other half to John . Kennedy, paper stainer, of England, whose whereabouts have Tbeeh traced. The affidavit of one of the claimants, who stated that be was a great grandson of Mary Hathaway, alleged that John Herring Kennedy, who was tried at the Old Bailey, London, in .September, 1824, for embezzlement, and sentenced to transportation for 14 years. Kennedy was eharged with having embezzled £37, 3s 6d ,and £25, from his employer, James Thomas Hathaway, said to have been the husband of Maf y Hathaway mentioned in the will. Officials records showed that Kennedy was sent to Van Dieman's Land in 1826. A Customs hook entry at Port Adeiaide showed that John Kennedy and his wife were among the passengers who arrived by the schooner Tamar on March 14, 1838. Mr. Justice Angas Parsons found that the persons entitled to the estate, in equal shares, were the issue of Mary Hathaway, who live in England.
