Litigation following the recent resignation of the Mayor of New York, Mr. James Walker, was heard before the Court of Appeal which declared that the ne.w Mayor must he elected on November 8 at the same time as the National elections. The New York Democrat convention noniinated Mr. John C. O'Brien as Mayoral eandidate. This represents tho choice of Tammany Hall, which has nominated Mr. O'Brien in preference to Mr. Walker or the acting Mayor, Mr. McKee. The decision followed a bitter fight. , Mr. Walker who was en route to New York aboard thci Europa, cabled at the last minute withdrawing hiS name, partially on account of illhealth and partially because he wished to avoid embarrassing the national ticket of Mr. Franklin Roosevelt whose friends at the convention, agreod to Mr. O'Brien's nomination but indicated that thc-y would fight for Mr. Walker whose name brought thundering applause from 3,800 delegates.
