MOWING CONTRACT
MAGISTRATE DISALLOWS CLAIM FOR LOST TIME AND BREAKAGES. In a civil action heard before Mr. S. L. Paterson, S.M., on Monday, E. Earle Vaile (Mr. J. D. Davys) sued Anthony Paton (Mr. R. Potter) for the sum of £43 11s lOd, made up' of loan £47 19s 3d, interest £4 19s lld, and file 1/- less an allowance for cutting 75 acres of hay. Paton counterclaimed for £14 15s, claimed to be due on-a contract for mowing 75 acres of hay, repairs to machine and loss of eleven days' time through condition of paddocks. He stated that by arrangement with Mr. Vaile's manager he was to receive 5s an acre and an allowance for breakages. Mr. Vaile and his manager denied 'any arrangement for payment for breakages or loss of time. Mr. Paterson held that there had ..jbeen no warranty against breakages and that there had not been the loss of time claimed. The counter-claim would therefore fail and judgment go to plaintiff for the amount claimed, £43 11s lOd.
