Rec. May 25", 7 p.m. LONDON, Wednesday. Mr. Justice McCardie caused a sensation in rebuking Mr. Justice Scrutton, one of the Lord Justiees of the Gourt of Appeal,. on his teeent remarks when { reversiijg the judgmeht of tHe bachelor Judge. Mr. Justice McCardie said; "Before this case be'gins, I wish to say that iii th& event of an appeal, I shall not supply a copy of my notes until I am satisfied that Mr. Justice Scrutton will not be a memh^l' of the Apjpeal Court. I regret it has , become my duty to administer this public rebuke to Mr. Justice Scrutton." Mr. Justice. Serutton had said that he was surprised that an unmarried [judge should have expl/ained what was the proper underclothing for a woman to wear. The TimeSj in an editorial referring to Mr. Justice McCardie's pontifical retaliation, expresses the hope that the undignified dispute will go no further as it is quite ineonsistent with the traditions of the Bench. "Frank and feerless expressions of opiniqn should be encouraged," sajd the journal. "Happily, however, incidents such as those of yesterday are rare. "Though they will not lessen public confidence in the judicial system, they must inevitably tend tq lessen public respect for the memirers of tbe judiciary who provoke them."
