PAYMENT OF STATE TAXES TO COMMONWEALTH GOVERNMENT SEVERE PENALTIES PROVlDED

Rec. April 6, 7.0 p.m. SYDNEY, Wednesday. The Financial Agreement Enforcement Act, commonly called the Garhishee Act, the validity of which the High Court upheld, provides, shortlj^, that the payment of revenue due to the State may be made by taxpayers to the Federal Government, instead of the State. Payment to the Federal authorities discharges the liability foi' payment to State officials. Penalties are imposed for payment by the taxpayer to any other than the Commonwealth. Any State Minister, officer or employee, is also subject to penalty for attempting to secure payment to the StAte. The Commonwealth is also 'empowered to retain loan money borrowed fof the State by the decision of the L'oan Council. Banks can be required to hand over money held or received on behalf of the State. Offences against the Act afe punishable, in summary proceedings by a fine up to £100 or six months' imprisonment, and on indictment by a fine of up to £500 or two years' imprisonment, or both.
