DEFENCE IN HONOLULU CASE SEEKS DISMISSAL OF INDICTMENT MOTION FOR BAIU ENTERBD Rec. Jan. 29, 5-5 P-m. "HONOLULU, Thursday. A new rnove to dismiss the indictment against Mrs Fortescue, Lieut. Massie and two naval enlisted men in connection with the death of a young Japanese, Joe Kahahawai, was made to-day following a supplementary motion hy the defence objecting to the foreman's action in not permitting the Grand Jury to ask the County Attorney to try an indictment for manslaughter instead of murder. The defence late to-day entered a motion to admit the defendants to bail. This* will be heard to-morrow. The Court ordered all guns and cameras to be taken from everybody except law officers at the Court room door in all hearings of this case.
