MISUNDERSTOOD INSTRUCTIONS SENT BY POLICE OFFICER JUDGE ACCEPTS APOLOGY HAMILTON, Thursday. The question of costs in a suceessful divoree suit, which was reserved
on Tuesday, was settled hy Mr. Justice Herdman in the Supreme ,Court to-day. On Tuesday counsel for respondent sought costs against petitioner, whose counsel objected and asked for time to consult the authorities. His Honour agreed, but on the, non-a'rrival of counsel after some minutes f^e Judge despatched a police sergean-t ?to inform him that if he did not* return immediately His Honour would leave the Beneh. Counsel failed to appear, and .in leaving the Bench His Honour* remarked that counsel's aetion was most disrespeetful. This morning counsel explained that he had misunderstood the police sergeant's instructions, and apologised for what appeared to he disrespect towards His Honour.* His Honour accepted the apology as counsel was under a misapprehension.
