DRIVERS FINED
TWO CONYICTIONS FOLLOW COLLXSION ON BAD INTERECTION Two lorry drivers. Theodore Yates and Isaac Anaru, appeared in the Magistrate's Court on Tuesday before Mr S. L. Paterson, S.M., on two charges arising out of a recent accident at the interestction of Ranolf Street and Malfroy Road. The two lorries collided on the interesection, I and the police, for whom Senior-Ser- ! geant Carroll appeared proceeded against Anaru on a charge of negligent driving and against Yates on a charge of failing to keep to the eorrect side of the road. Both defendants pleaded not guilty. . Anaru was represented by Mr E. Roe and Yateg hy Mr Potter. After hearing evidence- from the police and
traffic authorities and the two defendants, the Magistrate entered a conviction on each charge. Anaru was fined £2 with costs, and Yates' £1 with costs. His Worship remarked that the corner where the accident occurred was a bad one. From the evidence, it appeared that Yates had heen guilty of a breach of the regulations by failing to give way to a vehicle approaching from his right. Anaru had been charged with negligent driving. He admitted that he could have prevented the accident by stopping, but gaid that he thought he had the right of the road. There was no such thing as the right of the road; it was the duty of all drivers to take.proper care, having all regard to the circumstances of the case. In the circumstances of this case, it was the defendant's duty to have had his vehicle sufficiently under control to enable him to avoid the accident. It appeared that Anaru had heen driving at a speed which, on this particular corner, must he considered excessive.
