A German firm sought to compel an Italian firm which had contracted to supply British coal to fulfil its contract The Italians had refused on the ground that they bought the coal under an agreement not to sell to an enemy firm. The Supreme Court ruled that contracts made in Peru were not atfected by the British Trading with the Enemy Act.
