IN BANKRUPTCY.

MEETING OF CREDITORS-

The creditors in the estate of B. Phillips, fanner, of Awalmri, met at the Feildiug Courthouse yesterday.afternoon. The D.0.A., Mr G. J. Scott, presided. Mr J. Graham was solicitor for the bankrupt. The creditors present and represented were: —Messrs Lockhead, W. J. Neal. W. T. Hook, J. Gould, and G. Dear. The following was the statement of bankrupt;—Prior to last I worked for my father on the farm at small wages and living at home. On January 26th, 1907, I purchased a traction engine and threshing machine from Mr G. Woods, of Feilding, for £250. I gave in payment bills for fifty pounds, each falling ' due "at three - monthly intervals. I met the fir.st.’hnt failed to meet the other two, *ud one was renewed at ’ 7 per cent. I used the machine during four months cutting flax and stripping. I got flax cutting rights - on royalty at from 10s to 17s per ton, from Messrs' Strawbridge, Dear, Shalders, and others, and cut and stripped their flax. I sold the fibre to Ross and Sou, Foxton. With the wages to pay and expenses of working and bad weather, making broken ‘ ‘time, and loss in lifting wet fibre and laying it down again, and losing on the fibre when sold on account of the fact that it was a bad colour, I ' found I could not make ends meet. I stopped milling in October 1907, and since then have been cutting

firewood, threshing and chaff cutting / at intervals, and hoped to pull through by going on. I was sued by one Goodwin, under the Workers’ * Compensation' Act, in respect to an accident that happened to him at £> Awahuri on the ,Bth February, 1907, ; * whereby he lost a finger. The r Court ordered me to pay 30s a week to Goodwin as from the Stli Febru- • ary, 1907, to June 7tb, 1907, and thereafter 20s a week during the -total or partial incapacity of Good- ‘ win, and also £7 7s costs. Only ■ recently this order lias been varied i ; to one shilling a week. I paid Goodwin £SO ou account of the v amount due to him uuder the above

award. £25 of that amount -came out of my pocket and Mr Wood adcvSnced £35, as the machinery was in danger of being seized under the judgment. Wood then took security ;., over the engine to secure the i- promissory notes. As I could not t meet these JWood seized the engine Von April 28th, 1908. Since then I ;- ■ have been working at any odd jobs ' - that I could get and : ouly making wages. I the money to pay Goodwin on a bill of sale over my house. £3O was the amount. The balance went to pay rent then due.

Chamberlain £3 16s 9d, W. T. Hook £ll, R. W. Neill £2 2s, Atkinson & Co. £l4 18s 3d, G. Dear £l9 19s 9d ; ’ total £293 10s lid. The only secured • creditor is Mr R. J. Harper who has a bill of sale for £3B. The debtor having been examined the creditors appeared to come to the conclusion that it was a case of misfortune. Mr Graham was asked to collect the book debts and the meeting adjourned.
