ARREST WITHOUT WARRANT.
NOT JUSTIFIABLE. Per Press Association. Wellington, February 14. The appeal of Constable Turner against the decision of the Magistrate who convicted and fined him for assaulting Patterson, was argued before Justice Cooper to-day. The question turned on whether the constable acted rightly in arresting Patterson, who had used unjustifiable language to an officer.fand who was duly convicted and fined for so doing. * The Judge said the extreme course of arresting without warrant should be carefully scrutinised. In the present case it was quite clear that the constable had no justification for the arrest. The appeal was therefore dismissed, but without costs as respondent had brought all the trouble on himself.
