Press Association. Wellington, July 22. The Appeal Court to-day is hearing a motion by Canterbury Law Society to strike Frederick Fuller, barrister,off the roles or to suspend him bn the ground of failure to pay over money to a client and failure to keep' a trust account. In an affidavit Fuller admitted failure to pay but stated the money, £l4 13s, had been paid since and he thought he was entitled to retain it as it had been received in connection with an estate lie was settling. He denied that he intended to retain it permanently. On behalf of Fuller Mr Wilford urged that as there had been no dishonest v intent the Court should not make the rule absolute. The proceedings were a sufficient lesson-to his client and lie would not be likely to make suoh a mistake v again. * Fuller Was suspended for . six ‘ months and ordered to pay ten guineas Costs, The Court said that but for the affidavit the case might have bcoii dismissed as the money had been returned. The affidavit, however, in the opinion of the Court, made mat' ters worse.
In Rex v. Nordbury respondent was convicted of indecent assault and applied to the Appeal Court for a new trial on the ground that the verdict was against the weight of evidence and also for leave to appeal in forma papueris, being a foreigner and having no means. The Court granted leave and at the request of prisoner as signed Mr Wilford as his counsel.
