CLAIM FOR DAMAGES.
Per Press Association. GjinyMorj'fi, July 17. The District Court resumed at 10 o’clock this morning tho hearing of the claim for £SOO damages—Catherine and Walter Scott against Hugh Cassidy, for injuries received in a coach accident on the Otira-Christ-church road. Evidence for the defence went to show that the coach was perfectly sound and in good order, and the driver exercised all care. The jury retired at 7.30, and after an adjournment of thr.ne hoprs the following answers to the issues submitted wore giveu:—l. Was the coach unsafely loaded?—No. 2. Was the coacli in such had order and condition as to he unsafe and to contribute to the accident?—Yes. 3. Was there any defect in the coach to which tho accident was attributable which was either known to the defendant, his agent or servant, or which in the exercise of precaution nr skill, might hare become known to him or them? —No. 4. Was the said accident attributable to tho want of skill or the negligence on tho part of defendant’s driver? —Yes. 5. Was the said accident attributable to the unsafe loading?—No. (i. What damages?—£34 '2s, general damages, and £ls 18s special. Tho question of costs will bo settled to-morrow.
