PEIDAY, July sth, Before Mr Stanford, S.M,

T. Nolan was fined £5 and costa and bound over for 12 mouths in two sureties of £lO each for refusing to leave licensed premises when requested by the proprietor of Clifton Hotel to do so. Sorgeant Bowden prosecuted and Mr Cohen defended. Bulls Town Board v. (3-- D. Nipholson. Defendant is poundkeeper and some time ago ho sold a horse out of the pound for £2l. Tho Board sought to recover £lB of this amount, this being the balance accruing from the sale after allowing for expenses and pound charges. Mr Collins appeared for the defendant and submitted that the terms of Mr Nicholr son’s appointment entitled him to any profits that were made from pound sales. •Mr J. E. Walker, chairman of the Board, was called and stated that as far as he knew this had been the practice in the past. When the privileges were solcl ho understood that the poundkeeper was entitled to any profits to balance any losses that he might have. The present case was brought on to compel the ponndkeoper to place the money in the hands of the Board for the period of twelve months in case tho original owner of the horse was discovered, who is entitled to the amount. Mr Lyon, for the Board, -quoted the Impounding Act,'which says that the poundkeeper must hand over all surplus money from sales of impounded stock to the Board fotuS teen days after the sale. This money is to be held in trust for 13 mouths and if not claimed the amount , mast then be paid into the district fund. 1 His Worship held that this was thq point at issue and he said that hb had had experience in many districts but had never known of a ■ poiins being let under conditions like the one in question. He held that the Board holds the monies for sales in trust for the owner. The Act was plain on that point, therefore he would give judgment against defendant without costs.
