FINDLAY’S APPEAL.

I Mr H, Gorring, resuming his argu- ■ ment for Findlay in the Appeal S Court, laid stress on the fact that * Milieu and his son, who saw ami .1 spoke to a man with a bicycle on tho G night of the murder, could not ideu- i tify him as Findlay. The evidence .1 was suspicions to some extent but?* not enough so to convict. 1 Mr Myers, for tho Crown, re- I viewed all the evidence against I Findlay categorically, and show cd | how ho was connected with the.l articles stolen from tho house. Tliejl evidence, ho contended, would fij amply justify any jury in convict- | ing. 'Si Mr Myers pointed out that Find- | lay gave two reasons forJiis presence in' the neighbourhood, neither of which was borne out by facts. To |] those who did not know him he gave out that lie was a runaway sailor, toi those who did that lie had been witiiji a runaway sailor. He suggested that ;l his object was to create a false ideuV S tity in order to shield himself afteij | the robbery ho contemplated. As to} I the theory' that a revolver shot would} I have caused alarm the house was j standing alone and tho evidence orjl finger prints as far as it went showed | that one of the prints corresponded in I part witli prisoner’s but they wore I too much smudged for complete S identification.
