James McEvoy, described as a squatter of Guudagai, was defudaut iu an action brouglit by May Francis, of Crown street, Sydney, to recover £7O, money alleged to have been spent by her at defendant’s request, aud for accommodation. Defendant paid £25 into Court, aud pleaded that he was not indebted as to the balance. Plaintiff’s case was to the effect that defendant came down on “a bender, ’ ’ aud was accommodated at her house for ton days, for which he was charged £6. Other items in the , bill included eight cases of a special brand of champagne at £6l 5s per case, procured, it was stated, at defendant’s request; £1 for a turkey, which defendant entertained himself by killing; 10s for telegrams sent to his family intonating that he was. ‘ 1 all right, ’ ’ and various 'sums for cab hire aud dinners aud suppers ordered from Paris House. It was stated that defendant was on his way to England, and consequently could not attend Court. H;s counsel subuttted that [it was a case of attempted ‘ ‘ lambing down, ’ ’ and that the amount paid into Court was ample. The jury returned a verdict for the plaintiff for £33 Is 4d over aud above the amount paid into Court.
