CHEESE FACTOKY BUILDING DISPUIE. lIMFIKE'S AWAKU.

Mr Ashley J. Hunter, M.1.C.E., tbe umpire who presided at the recent arbitration proceedings concerning the erection of tbe Aka Aka Cheese Factory, in which the rival parties were Mr J. I'. Hewson, ot Pukekohe, the builder of tbe factory, and the Waikato Co-op. Cheese Co., Ltd., the owners, has now issued his award. In tbe claim of the Company against Mr Hewson of £294" for delay in completion of contract (98 days at £3 per dry), £453 17a 3d for loss on chease price (49 days at £9 6s 3d per day), £25 17a lid for manager's wages and £7 10s tor rent of bouse for manager, the Umpire awardrd nothing, but ordered Mr Hewßon to pay the sum of £lO in respect of tha Company's claim of £l7 14s for earthwork tilling done by the Company. In Mr Hewson'a crrs?-claim Bgainst the Company, the Umpire awarded Mr Hewson £216 Os 3d out of £264 5s lid chimed for balance due on contract and extra*, £5 for expenses paid to expert for fixing whey-tank and £8 13s for interest on amount cf unpaid certificates, but did not entertain the claims of the following items: £2O for delay in obtaining possession of site, £SO for delays caused thr< ugh non-fixing of level*, £25 for loss through delay in delivery of metal on sjte, and £25 10s for loss through work beiog pushed over into bad weather. Summaiising the above, the Umpire directed the Company to cay Mr Hewson the sum ot' £219 13i 3d in final edj stmect of all matters in dispute, and out ot costs ot the arbitration, totalling £95 4«, tre apportioned £7l 8s to be borne by the Company and £23 15a by Mr Hewson.
