PUKEKOHE MAGISTRATE'S COURT.

Friday, 2nd June. (Before Mr F, V. Frazer, S.M.)

CIVIL ACTIONS.

Judgment by default was given for plaintiffs in each of the following cases, viz :—William Hayward, of Bombay (Mr W. P. Hopkins), v. Mrs Peirce, of Pukekohe, for £l4, and costs £1 10s 61; and Messrs Frank Perkins and Co. v. Sydney Martell, Ltd., merchants, Hastings, for £37 Us 6d and costs £2 4s.

JUDGMENT SUMMONS. In toe judgment summons case Dr A. Bronte (Mr Hopkins) v. E. Keade, an order was made for payment of £5 4s, the amount claimed, in payments of 5s weekly, conditionally that defendant handed over bis business accounts to Mr Hopkins to collect.

ADMITTED TO PROBATION. Thomas E. Skinner, who until recently carried on a plumber's business in Pukekohe, was charged with having tendered an argeement purporting to be signed by W. Guest, carrier, of Pukekohe, whereby he obtained the sum of £5 from Mr McClintock, cabinetmaker, of Pukekohe. —Mr Endean appeared tor accused. . ,

The evidence went to show that on tha completion of a plumbing contract Mr McClmtuck was to pay accused the sum of £lO, but Mr Guest, a carrier, got a lien on the money, and when defendant applied to Mr McClintock for a portion thereof he refused to pay out. Accused unsuccessfully solicited Mr Guest's solicitors, and Mr Guest lor permission to get the money, and thereupon he proceeded to draw up an agreement to which he attached Mr # Guest's signature for the money to be paid to him. He presented the agreement to Mr McClintock and obtained the £5.

Mr Endean pleaded for leniency on behalf of the accused. He said that the trouble had arisen as a result of his financial position. Through his business falling away accused was compelled to send his wife and children to Auckland,-and out of a desire to eend them money he had fallen in to the temptation. Accused had no previous convictions. He therefore asked that he be given the benefit of the First Offenders' Probation Act. Constable Thornell stated that the accused was a respectable citizen.

The Magistrate remarked that accused bad committed a most serious fcrgery, but nevertheless he would admit him to probation for two years, conditionally that he made satisfactory arrangements in connection with the £5 or the payment there:: within three months. Accused would have to regularly report to the Probation Officer, the Rev. Jeffriep, in Auckland, who would assist him.
