DRURY

Despite the inclement weather on Monday last, the send-off to "our boya" who are going to the Front was aTiigbly successful function, and passed off with a swing and vim that waa delightful to aee. Tbe arrangementa made by Mr fooman, secretary to the Send-off Committee, left nothing to be dtsired, and the apeeches of farewell and God Speed wcie listened to with inpt attention by all at tbe function, No leas than four of "our lada'* lined up on the platform Sergeant Jamea Flanagan aad his cousin, l'rivate Edmonds who are about'to proceed to toe frunt very socn, and also the Brothers Perry who have enlisted, and are anxioua to do their bit. Although not going to the front for sjme time the Committee honoured the latter for their pluck and spirit, ar.d the district is proud to have such youths to send to fight our Empire's battles.

The sale of work held here recently by the Ladies' Guild of the Presbyterian Church waa not so Successful aa the one held last yfir, owing, no doubt, to the call of the Patriotic Committees, who ihave had many things in hsnd lately. The ladies will perhaps have better luck next time.

Wednesday saw "another Bend-off to Sergeant J. Flanagan. The Diury Bible Class, of which he was a member, turned out en masse to do their loldier member honour, to give him a small token of regard, and to bid him God Speed. The social was a great success, and was much enjoyed by young and old.

TUAKAU

The Rev. L. toulkes, hitherto Vicar of Pokeno, has arrived in ihe district and assumed his new duties as Vicar of the luakau Parieh yesterday, when be preached at the morning service. On Wednesday next the parishioners ol the Tuakau Anglican Church are to hold a social, which will serve the double purpose of farewelling the Mev F B Dotson, who ofter seventeen years is exchanging parishes with the Rev Cowie, of Paeroa, and of a reception to the new vicar and Miss Foulkes. Ihe Rev Mr Dobson is to be the recipiett of a set of harness, while Mrs Dobson will also be handed a handsome present.- > Although the weather has been most favourable and the courts are lh excellent oider for tennis, the enthusiasm that characterised the Tuakau Tennis Club'B previous seasons has died away considerably, and little, if any, interest is being taken in the pastime. A number ef last season's male members are at the front, while others ate engaged in attending to their flower and vegetable gardens. The beneficial effects of the prevailing seaeon are to be Been on every hand throughout the district, the extra feed for cattle in the paddocks being particularly noticeable. In some cases it has been most prolific, as instanced on Mr F Lawson's farm on the river bank, where seventeen truck loads of store cattle from the South were liberated last week. A good supply of scoria has come to hand for works to be undertaken by the Town Board on the Pukekohef«uckland road footpath and general Repair work in the Town Board area. Metalling, which waH urgently needed un the Kiver road, in the vicinity of the White bridge, is proceeding to the satisfaction of all concerned. Ihe representations, made to the Railway Department by the 'l'uakau Town Hoard for improved facilitiee regarding a t-ain service from Auckland, that would allow of goods arriving at luakau to be taken delivery of on the day of arrival, instead of having to wait until the following day, which was the case until recently, had its elfect, the summer service now in operation meeting with the requirements of the business people. The speeding up of the mixed goads and passenger txain which used to leave Jfukekohe for 'luakau at 4.15 p.m. to 4.5 P- m • is another improvement that has given much satisfaction, and ia a direct benefit to tbe district. The popular side shows. "Kaiser Bill" and "Skittle Alley," which were used with succeaa at both Carnival Sports gatherings here and were lent to the Pukekche Carnival Committee, are to do further service at a Patriotic Carnival to be held «t Onwehero and two other functions. They are of local manufacture, Mr Patterson, of Messrs Green and Co'.ebrooks', being the designer of "Kaiser Bill," while Mr J. Pirret is ihs owner and maker of the skittle outfit.

COMMISSION CLAIM

Judgment in an interesting ccmmniion casa in which Henr> Clayton and Co. (Mr A. E. Skelton), land Hgents, Auckland, claimed £ll4 15a from Robert Hall (Mr A. Hanna) farmer. Aka Ak*, was received from Mr E. W. Barton, S.M., and read in the Auckland Magistrate's Court on Saturday. Plaintiffs' claim was for commission at 5 per cent. on the tint £IOO and 2J per cent on the bohnce in respect of the sals at £sl per acre of lot 183, Waiuku East, containing 90 acres, more or less. The terms of plaintiffs' authority were that ihe time for effecting the sale was to be not less tban three months, and thereafter till withdrawn by Cefendant by giving fouiteen days' notice. It was shown at the hearing that Mr P. 0. Mellsor, of Mellsop and Herrold, land agents, approached defendant and asked permission to sell tin property, but defendant told him toat the property was in the bands of plaintiffs as sole agents. However, an agreement was entered into between Mr Mrllsop and plaintiffs whereby he was to be allowed one half of the commission ii be found a buyer. On July 12th Mellsou met defendant in plaintiifs' office and told him that he had two buyers practically ready to complete th£ purchase of defendant's property. Defendant replied, "1 am thinking of withdrawing the property as my wife wishes to go back there to live and I don't want to fall out with her over it." On July 16tb Mr Mellsop took his prospective buyers to plaintiffs' office, and an agreement was drawn up by plaintiffs and signed. Before the agreement was executed plain* tiffs, on July 13th, had received a letter from defendant purporting to terminate plaintiffs' agency, and in September defendant sold the property to his brother, Mr G. Hull. At the hearing ot the case defendant's solicitor, without calling evidence, moved for a non-suit, or for judgment for defendant, on the ground that 1 the purchase agreement drawn up by plaintiffs was made in terms beyond the scope of plaintiffs' authority, in that it included certain provisions not authorised by defendant.

The Magistrate held that plaintiffs' authority to sell was irrevocable for three montbß; tbat the purchase agreement was not unreasonably in excess ot the authority; and tbat on July 16tH, during the currency of the plaintiffs' agency, plaintiffs had fully performed their agreement.

Judgment was given in favour of plaintiffs for the full amount claimed, with costs according tu scale.

MANUREWA.

It is expected that a commencement will be made this week with the formation of footpaths in the Manurewa township. The work will be conducted by the Manukau County County Council, who also intend to reform the roal from the bridge near Glenora Park to the Papakura Town Boundary. The Manurewa Musical Society shortly intends giving another concert. Th° members are practising asuduously and it is anticipated that the Society will ex<sl itself on the occasion under notice.
