SALE OF HAY STACK.

A transaction in which the sale of a stack of hay was the central point resulted in a case which occupied Mr E. Cutten, S.M., the greater portion on Thursday last at the Auckland Magistrate's Court. The plaintiff, William Wilyon, farmer, of Otahuhu, (Mr R. J. Coates). sued Patrick Lawery and L. W. Schmidt, farmers of East Tamaki and Papakura (Mr J. R. Lundon), to recover £35 alleged to be due in connection with the sale of a stack of hay and cash lent. To this defendant counter-claimed £3B for ploughing and other work done. The evidence showed that the stack of hay was sold by defendants through the Farmers' Union, that the latter agency gave a cheque to plaintiffs for £6O, part of the money received for the hay. Plaintiff, therefore, claimed £35 as balance still due. Mr Lundon claimed that defendants were entitled to deduct the cost of certain work done by them, from the price of the hay. Mr Cutten, however, held that defendants were bound by the written agreement which stipulated that the purchaser was to pay all costs in connection with cutting and stacking the hay. Judgment was given for the plaintiff for the amount claimed, £35, with costs £8 sa. The counter-claim was dismissed, plaintiff being allowed £2 2s costs
