NEW TOWN DISTRICTS.

Tuakau and Waiuku. County Solicitor's Opinion. Must be Under the County Supervision. At Thursday'* meeting of the Franklin County Council the county solicitor (Mr A. Hanna) wrote:— "There is one point I would enlarge on and that is that by an amendment of the Town Districts Act, 1908, certain restrictions are imposed on the severance of Town Districts from the county control, the chief one, apart from purely procedural provisions, being that the population of the town district must exceed 500. Consequently, unless the population cf either Tuakau or Waiuku town districts exceeds 500 I fear the proposed severance from the county cannot be carried out."

Cr Henry: Is Tuakau's population 500?

Cr Fulton: Not yet. But the county need not strike a rate. Ttie chairman: That is bo far as this Council is coacemed. But the juiisdictioo will remain and future councillors may strike a rate. Kenall: 1 am sure the county does not want to have anything to do with the town districts. We have enough to do ourselves. Mr J. C. Dromgool, mho was present in the auditorium, rose and said that he represented some of the Tuakau objectors. He was glad to heat what Mr Hanna had said, but Mr Fulton had given an assurance at Tuakau which was contrary to the solicitor's advice. Cr Fulton said the assurance he gave was that the Council did not intend to strike or collect a rate, and that the Council was unanimously in favour of attempting to get an Order-in-Council, excluding the town district. That was the position now; the Jouncil was unanimous not to sti ike the rate and unanimous to get exclusion for Tuakau, if possible. Mr Uromgool: But 1 gave the assurance all along that the Governor could not grant exclusion even if he wanted to. The matter then prepped.
