AN OFFER REJECTED.
OVERDUE ACCOUNT. Case of Hardship. A letter was received from a firm of solicitors on behalf of Mr. Crabb (Matamata) by the Thames Valley Power Board last week in connection with the statutory charge the board proposed to register against his land.
It was stated that the farm had been purchased from Mr. R. S. Lewis and no mention was made in the conditions of sale that the electrical installations had not been paid for. The hoard’s account was a substantial one, and it was not unreasonable to assume that had their client been aware of the debt before he purchased he would not have bought it. The case was one of distinct hardship because Mr. Crabb had either to pay a debt contracted by another or go to the expense of resisting the board’s claim. An offer of £SO was made without prejudice in full settlement of the board’s claim.
The chairman said the account was £B3 13s, and the board would be losing the interest for five years. He -ould not agree to the acceptance of the offer.
The manager said the matter had been under consideration for four years, and the board had to sue to establish a claim. Mr. Price: The board has given every opportunity to pay the account and every effort has been made to extend the law in order to get out of payment, ending finally in the offer before the board. The offer was rejected.
